Employer accused of failing to keep employee healthy and safe

A globally relevant mineral producer was blamed for a workplace incident.

WorkSafe recently initiated a prosecution under the Work Health and Safety Act against Evolution Mining (Mungari) and its haulage crushing contractor.

“MLG OZ Limited and mine operator Evolution Mining (Mungari) Pty Ltd have both been charged with failing to ensure the health and safety of a worker and, by that failure, causing serious harm to an employee,” WorkSafe WA said in a public statement.

“A heavy diesel mechanic’s arm was crushed when he was attempting to clear an obstruction near an unguarded roller of a mobile stacker at a gold mine west of Kalgoorlie in April 2022.”

The matter will be first mentioned in Kalgoorlie Magistrates Court on 24 June 2024. If Evolution and MLG are found guilty the maximum penalty is $3.5 million.

“More serious breaches may risk penalties including terms of imprisonment for individuals. It is disappointing that workers continue to suffer serious or permanent injuries due to failure by employers to comply with their obligations under work health and safety laws,” acting WorkSafe commissioner Sally North said.
